Introduction

SSBK Construction Pty Ltd (hereinafter referred to as “We,” “Our,” or “Us”) is dedicated to upholding the highest standards in design, construction, quality, and customer service. Our commitment has established us as a high-quality home builder in Australia. To reinforce this commitment, we offer a Lifetime Structural Guarantee on many of our new home building contracts signed after 01 October 2024.

Guarantee Coverage

This Lifetime Structural Guarantee is supplementary to any statutory insurance, homebuilders liability schemes, or other guarantees provided under Australian law. It is specific to the original owners named in the building contract (hereinafter referred to as “You” or “Your”) and is not transferable to subsequent owners of the property.

SSBK Construction’s Responsibility

Under this Guarantee, we will rectify, at our cost, the structural failure of the following:

• Foundation Systems: Including concrete and strip footings, in accordance with the Building Code of Australia and relevant Australian Standards, such as AS 2870, Appendix B.
• Structural Timbers and Steel: In wall or roof framing, as defined by the Building Code of Australia and relevant Australian Standards, including AS 1684.

• Load Bearing Brickwork: As per the Building Code of Australia and relevant Australian Standards, including AS 4773.

Your Responsibility

To maintain the validity of this Guarantee, you must:

• Adhere to the maintenance guidelines provided in your building contract and any applicable documents, including those specified for your State (e.g., NSW: CSIRO guide – Foundation Maintenance and Footing Performance: A Homeowner’s Guide).
• Follow any revisions to these documents issued over time.

Failure to maintain your home as outlined may void this Lifetime Structural Guarantee.

Exclusions

This Guarantee does not cover:

• Losses due to non-compliance with your maintenance responsibilities.
• Site conditions arising after settlement that are beyond our control.
• Damage caused by storms, fire, flooding, drought, or earthquakes.
• Damage resulting from trees growing near the footing of your home.
• Fair wear and tear.
• Misuse or neglect.
• Minor cracking as defined in AS 2870 Appendix B.
• Failure to follow site maintenance guidelines provided by us, including landscaping, drainage, and termite prevention.
• Renovations, additions, or structural changes made after completion of the home.

This Guarantee excludes non-structural items such as scratches or marks on benchtops and vanities.

Eligibility for Claims

The Guarantee is available to the original owners named in the building contract and is valid for the duration of their ownership. For company owners, the guarantee period extends for 50 years from the issue of the certificate of occupancy. This Guarantee is not transferable or assignable.

Making a Claim

To make a claim:

• Submit your request in writing to us via post or email at the addresses provided above.
• We will review your claim and inspect the property to determine if the issue qualifies under this Guarantee.
• We will respond in writing with the outcome of our assessment.
• If the claim is valid, we will initiate rectification work within a reasonable timeframe at our cost.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. If repair is possible, we will repair the goods; otherwise, we will replace them to rectify the structural failure.

If it is determined that there is no structural failure or that the failure does not meet the Guarantee requirements, you will be responsible for all rectification costs.

Note: A copy of this Lifetime Structural Guarantee is included in your Building Contract for your reference.
